TERMS OF USE — Version 1.2 — October 27, 2026

1. What this site is

Verified Risk ("Verified Risk," "we," "us") means the Verified Risk online service together with its owner and its operators, in every Section of these Terms. Verified Risk operates an automated interactive computer service that compiles and republishes information obtained from publicly available sources, including federal, state, and county government records and other public databases (together, "Public Records"). We do not inspect, visit, test, or investigate any property, and we do not create, alter, verify, or certify the underlying records. The service is designed to report what the Public Records returned for the search parameters used, on the date shown in the report, and nothing more: if a source we consult returns no matching record for an address, or cannot be queried for an address, the report is designed to state that plainly, and the service is designed not to estimate, infer, model, score, or fill gaps. Where a source dataset is itself a modeled or area-level product (for example, wildfire hazard potential or county radon zones), the report identifies it as such and does not present it as a record about the specific property. This Section describes the service's design and scope and is subject to the disclaimers and limitations in Sections 2 through 5; outputs can be affected by source outages, source data changes, address-matching limits, and processing errors.

2. Free service, provided "as is."

Reports and all other content on this site are provided free of charge, for general information only, "as is" and "as available," without any warranty of any kind, whether express, implied, or statutory, including any warranty of accuracy, completeness, currency, address-matching precision, merchantability, non-infringement, or fitness for a particular purpose. We may change, suspend, or discontinue the site or any report feature at any time without notice.

3. Public Records can be wrong

Public Records contain errors, omissions, delays, mismatches, and outdated information, and records can change after a report is compiled. Information is reproduced as retrieved from the source, and the appearance of any record in a report is not a finding, conclusion, or judgment about any property or person. A section reporting no records means only that the named database returned no matching records for the exact search parameters used; address-formatting differences, alternate parcel identifiers, and geocoding approximations can cause relevant records in the same database not to match a searched address. You must not rely on a report, in whole or in part, as a basis for any decision, including buying, selling, leasing, lending on, insuring, or occupying a property, or any health or safety decision. Verify independently, through your own inspection, survey, appraisal, and consultation of official records, before acting.

4. Not professional advice; not a consumer report

Nothing on this site is legal, engineering, surveying, appraisal, environmental, insurance, or other professional advice, and no professional relationship is created by your use of this site. Verified Risk is not a consumer reporting agency. Reports from this site are not "consumer reports" as defined by the Fair Credit Reporting Act (15 U.S.C. § 1681a) or any similar state law, and you agree not to use this site or any report to determine any person's eligibility for credit, insurance, employment, housing, or any other purpose covered by those laws. You agree not to use this site or any report to evaluate any individual person, including any person's creditworthiness, character, reputation, personal history, or standing, and not to use it in connection with tenant screening or the evaluation of any residential lease applicant.

5. Agreement not to sue; release; limitation of liability

To the maximum extent permitted by applicable law, in consideration of free access to this site and its reports, you agree that you will not bring, file, or pursue any claim, lawsuit, action, or demand of any kind against Verified Risk, its owner, or its operators, and you release and waive any such claims, arising out of or relating to this site, any report, or the Public Records they contain, including claims based on ordinary negligence, negligent misrepresentation, alleged inaccuracy, incompleteness, address mismatch, delay, or your reliance on the information. To the same extent: (a) Verified Risk, its owner, and its operators shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or other damages of any kind arising from your use of this site or any report; and (b) if any liability is nonetheless imposed, it shall not exceed the total amount you paid to use this site, which is zero dollars ($0), or, solely if applicable law prohibits a zero-dollar limitation, fifty dollars ($50). Some jurisdictions do not allow certain waivers; in those jurisdictions this Section applies to the fullest extent permitted.

6. Your responsibilities

You represent that you are at least eighteen (18) years of age and have the legal capacity to enter into these Terms. If you use this site in a professional or representative capacity (including as a real estate agent or broker), you represent that you have authority to bind your employer or brokerage to these Terms. You agree to use this site only for lawful purposes. You agree not to use information from this site to harass, threaten, or harm any person; not to use it for any purpose prohibited by Section 4; and not to copy, scrape, or redistribute reports in bulk. You may share an individual report with a client or counterparty for their personal or internal business evaluation only if you: (i) provide the complete, unaltered report, including its first-page notice and its closing footer; (ii) do not charge a fee for the report, and do not present it as an inspection, an environmental assessment, or a clearance of the property; and (iii) tell the recipient that the report is subject to the disclaimers printed in it and to these Terms.

7. Indemnification

You agree to indemnify, defend, and hold harmless Verified Risk, its owner, and its operators from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use or misuse of this site or its information, your sharing or characterization of any report, or your violation of these Terms. This Section does not apply to a good-faith legal challenge brought solely to test the validity of a provision of these Terms, to the extent applying it to such a challenge would be prohibited by law.

8. Acceptance is recorded; correcting a record

When you check the agreement box and select "I Agree — Enter," we record the date and time, the version of these Terms you accepted, and technical information about the request (such as IP address and browser type). That record is evidence of your acceptance. Accessing any page of this site after acceptance constitutes your continued agreement for that visit. The collection described in this Section, and our other data practices, are described in the Privacy & Data Practices Notice linked on the entry page. Verified Risk compiles records from government databases it does not control and cannot edit them. A request to correct an error in an underlying record must be directed to the agency identified in the report's source line for that record. At our sole discretion, and without any obligation to do so, we may re-retrieve a record after the source agency corrects it, or suppress a report for an address while a source error is resolved.

9. Governing law; venue; severability; entire agreement

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any lawsuit, action, or proceeding arising out of or relating to these Terms, this site, or any report must be brought exclusively in the state courts located in Franklin County, Ohio, or in the United States District Court for the Southern District of Ohio, and you consent to the personal jurisdiction and venue of those courts and waive any objection based on inconvenient forum. All claims must be brought in your individual capacity only; you agree not to bring or participate in any class, collective, or representative proceeding. Any claim arising out of or relating to this site or a report must be filed within one (1) year after the compilation date of the report at issue, or it is permanently barred. If there is any conflict between the plain-English summary on the entry page and these Terms, these Terms govern. If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed, and the remaining provisions will continue in full force. These Terms are the entire agreement between you and Verified Risk regarding your use of this site.
